On Friday, I published a brief article about the USGBC’s new LEED registration and certification agreements. Well, it appears that they had already been published at the time that my article went to post. Ladies & gentlemen – we have a new set of LEED contracts.
The new LEED Agreements can be found by visiting LEED Online. On their extensive “Legal” page, you can find the entire collection of current LEED documents. The Certification Agreement and Registration Agreement were published on January 11, 2011.
I will be taking a look at these new agreements over the course of the week and offering comments and questions to all of you. In a cursory review, you can see that the USGBC has shortened the agreement and has made a few changes:
- Clarification of who can register to certify – now only properly appointed agents (using USGBC agent form) can register .
- Removal of IP regulations – these have been moved to the certification manual, for the most part.
- Limitation of liability – the USGBC is setting a liquid sum for damages
- Removal of the mediation process – no longer is there a mandate for mediation
